By accessing or using the Service, you confirm that you are a registered estate agent or agency operating legally within South Africa and that you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Agent Registration and Verification

  • You must provide accurate, current, and complete information during the registration process.
  • You are required to upload necessary verification documents (e.g., Fidelity Fund Certificate, CIPC document, ID) as requested.
  • Thola Indawo reserves the right to approve or reject any agent registration application at its sole discretion.
  • You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

3. Listing Content and Responsibility

  • You are solely responsible for the accuracy, legality, and content of the property listings you post on the platform.
  • Listings must accurately represent the property and comply with all applicable South African laws and advertising standards.
  • You must have the necessary rights and mandates to list the properties you advertise.
  • Thola Indawo reserves the right to remove or modify any listing that violates these Terms or is deemed inappropriate.

4. Subscription Plans and Payments

  • Access to certain features of the Service requires a paid subscription ("Basic" or "Premium").
  • Subscription fees are billed on a monthly or annual basis as selected during registration and are non-refundable.
  • Failure to pay subscription fees may result in suspension or termination of your account.
  • Thola Indawo reserves the right to change subscription fees upon reasonable notice.

5. Use of the Platform

  • You agree to use the Service only for lawful purposes related to your real estate business.
  • You agree not to misuse the platform, including engaging in fraudulent activities, spamming, or uploading malicious content.
  • Lead information obtained through the platform should be used solely for the purpose of contacting potential tenants regarding the specific property inquired about.

6. Termination

Thola Indawo may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Thola Indawo makes no warranties, expressed or implied, regarding the operation or availability of the Service, or the information, content, or materials included therein.

8. Limitation of Liability

In no event shall Thola Indawo, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
